Desert Harvest collects over 120,000 pounds of food a month for people in need. This is largely surplus or over-runs from restaurants and grocer that is date, but still good food. This would not be possible without the generous support of our food donors. State and federal laws as well as our recipient organization liability release protect food donors from all liabilities. Desert Harvest drivers are trained in safe food handling and can supply food-grade packaging if needed by the donor. We can pick up either regularly or on-call to fit your schedule. There is no fuss or paperwork on the donor's side. We make it simple and convenient to help those in need.
The Emerson Act (HR 2428) was enacted in 1990 to encourage donations of leftovers to food rescue programs. Food donors acting in good faith shall not be subjected to civil or criminal liability arising from the “nature, age, packaging or condition of apparently wholesome food.” New Mexico Statute 41-10-3 (1978) protects food donors acting in good faith from any civil liability or criminal penalty regarding condition of the donated food.
