If you would be interested in joining this generous group of food service professionals, rest assured that you have legal protections that back your commitment to fight hunger. Desert Harvest drivers are trained in safe food handling and equipped with food-grade packaging, coolers, and blue ice. In addition, State and federal laws protect donors from liability.

New Mexico Statute 41-10-3 (1978) protects food donors acting in good faith from any civil liability or criminal penalty regarding condition of the donated food.

The Emerson Act (HR 2428) was enacted in 1990 to encourage donations of leftovers to food rescue programs. Food donors acting in good faith shall not be subjected to civil or criminal liability arising from the “nature, age, packaging or condition of apparently wholesome food.”
